These terms and conditions, which we may update from time to time, apply to our website (“huntingtrips.com.au”), emails, text messages and social media accounts. When you use our services, you confirm that you have read, understood and to be bound to the terms and conditions set out below (including the Privacy Policy).

Our Services

Hunting Trips Australia provides an online platform through which hunting service providers can advertise and list their services to users looking to engage with these providers and their services, as well as a membership program for hunters to gain access to benefits (“our services”). These services can include (but are not limited to) guided hunts, safaris, private property access, training, courses, game park access or ranch hunts, discounts and content.

By contacting a business listing on the website through Hunting Trips Australia, you enter into a direct relationship with that business external and removed from Hunting Trips Australia . From the point at which a user makes contact with a business via the website, Hunting Trips Australia has no role, accountability or association with any future communication, agreements or services promised or provided through this relationship. Hunting Trips Australia solely operates as a advertising platform listing hunting business services, not a provider or faciliatory of these services.

By using this website you agree and acknowledge that the listed hunting business is at all times responsible for the delivery, accuracy, scope, safety, insurances, cancelations, refunds, communications, disputes and quality of it’s advertised listing.

The information on the huntingtrips.com.au website is provided on an “as is” and “as available” basis and is based on the information provided to us by hunting businesses registered on the platform. As such, the hunting businesses are given access to an dashboard through which they are fully responsible for updating listing information which is displayed on our website (including prices). Although we will use reasonable skill and care in performing our services we will not verify if, and cannot guarantee that, all information is accurate, complete or correct. Each hunting business listed on the website remains responsible at all times for the accuracy, completeness and correctness of the information displayed on our website pertaining to their own listing.

Our services are made available for personal and non-commercial use only. Therefore, you are not allowed to resell, use, copy or transmit any content or information, services available on our website for any commercial purpose.

Public use and prices

Our services are free of charge to public users seeking information on hunting related experiences.

Our services are not directed at children under 18 years old. By using the website, contact forms and other “services” you acknowledge that you are either 18 years or older.

All advertised prices on the Hunting Trips Australia website are displayed including GST tax and all other taxes, unless stated differently on the website.

Sometimes special offers with cheaper rates are available on our website for a specific hunting tour or trip, however, these offers may carry special restrictions and conditions, for example in respect to cancellation and refund. Please check the listing details thoroughly for any such conditions prior to making contact with relevant business. All special offers are marked as such.

Hunt Cancellation

By making an external reservation with an hunting business outside of the Hunting Trips Australia website, you accept and agree to the relevant cancellation and no-show policy of that business, and to any additional (delivery) terms and conditions of the business that may apply to your reservation or during your hunting trip, including for services rendered and/or products offered by the outfitter (the delivery terms and conditions of an outfitter can be obtained with the relevant hunting trip provider). Note it is the hunting businesses responsibility to include general cancellation and no-show policy of each hunting trip on our website on the hunting trip providers listing information pages. Please note that certain hunting listings of services or special offers are not eligible for cancellation or change. Please check the hunting listings details thoroughly for any such conditions prior to making your reservation. Please note that users should always base a decision to book a hunting experience based on the information provided directly by the hunting business through external communication with, or via their website. Hunting Trips Australia cannot guarantee the accuracy of the information listed in a hunting businesses listing. Hunting Trips Australia is not responsible or accountable for the delivery or quality of a given hunting listing.

Hunting Trips Australia makes no warranty, and expressly disclaims any obligation, that: (a) our website will meet your requirements or will be available on an uninterrupted, timely, secure, or error-free basis; (b) the content will be up-to-date, complete, comprehensive, accurate or applicable to your circumstances; (c) the results that may be obtained from the use of our website will be accurate or reliable; or (d) the quality of any products, services, information, or other material obtained by you through the site will meet your expectations.

Subject to the limitations set out in these terms and conditions and to the extent permitted by law, we shall only be liable for direct damages actually suffered, paid or incurred by you due to an attributable shortcoming of our obligations in respect to our services.

However and to the extent permitted by law, we (together with our officers, directors, employees, representatives, affiliates, and providers) will not be responsible or liable for (a) any damages to or viruses that may infect your computer equipment or other property as the result of your access to our website, your downloading of any content from our website, (b) any punitive, special, indirect or consequential loss or damages, any loss of production, loss of profit, loss of revenue, loss of contract, loss of or damage to goodwill or reputation, loss of claim, (c) any inaccuracy relating to the information (including rates, availability and ratings) of hunting tours available on our website, (d) the services rendered or the products offered by the outfitter or other business partners, (e) any (direct, indirect, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, pursuant to, arising out of or in connection with the use, inability to use or delay of our website, or (f) any (personal) injury, death, property damage, or other (direct, indirect, special, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, whether due to (legal) acts, errors, breaches, (gross) negligence, willful misconduct, omissions, non-performance, misrepresentations, tort or strict liability by or (wholly or partly) attributable to hunting tours.

You agree and acknowledge that the hunting business listed on the website is at all times responsible for the collection, withholding, remittance and payment of the applicable taxes due on the total amount of the hunting listing price to the relevant tax authorities. Hunting Trips Australia is not liable or responsible for the remittance, collection, withholding or payment of the relevant taxes due on the hunting tour price to the relevant tax authorities.

Membership

By subscribing to a Australian Hunters Club you will be bound by these Terms & Conditions and you acknowledge that you satisfy all eligibility requirements. “Australian Hunters ” means AMELPA PTY LTD or any of its affiliates.

i. Giveaways

a) Eligibility. Any member with a Premium or Platinum membership is eligible to win a product giveaways, and are the legal age of majority in their state or country of residence prior to the date of entry.

Any member with a Platinum membership is eligible to win a guided hunt giveaway, and are the legal age of majority in their state or country of residence prior to the date of entry.

Employees of Sponsor, Australian Hunters and its affiliates, and their immediate family members are not eligible to participate.

b) Sponsor. The Sponsor is the individual or entity offering the product or guided hunt as part of the giveaway.

c) Prize(s) and Winner Selection Method. Australian Hunters will award a prize to one or more individuals who are eligible. The give announcement post accessible via the news page, will specify the prize(s), prize specifications, how to enter, any giveaway specific special conditions, and when each giveaway ends (which may be sooner than the end dates and times provided depending on the available supply of prizes). Potential winner(s) will be selected at random from among all eligible entries received. If you are a winner, an e-mail notification will be sent to you. A post will also be created and released on the members news page.

You must be an active Australian Hunters member with eligible membership tier to receive a prize. Limit one entry per member. Prize(s) will be fulfilled by either the Sponsor or Australian Hunters. Prize(s) will either be delivered by Australian Hunters or one of its affiliates or by the Sponsor using the shipping address provided in the giveaway entry form (not your address listed in your accounts page). Each winner will be responsible for paying any taxes and any other expenses incurred, including any income taxes, sales or use taxes, value added taxes, goods and services taxes. Throughout the term of this giveaway, you will provide Australian Hunters with any forms, documents, or certifications as may be required for Australian Hunters to satisfy any information reporting or withholding tax obligations with respect to any payments related to this giveaway.

Each prize will be awarded “as is” and without warranty of any kind, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). If you win a prize, you may not transfer, assign, or redeem the prize for cash. The Sponsor or Australian Hunters will not substitute a prize with another price.

d) How to Enter. To enter a giveaway elidable members must find the giveaway post listed on the members news page and complete the giveaway form providing accurate information. Forms are scheduled and will expire after the giveaways termination date (generally, but not always, 11:59pm on the 31st of a given month).

e) Giveaway entry restrictions – giveaways are limited to one entry per month. Members who submit multiple entries via the giveaway form will be automatically disqualified.

f) Disclosure in Connection with Entry. If you choose to promote your entry (including the listed giveaway prize) via social media or other channels, you should disclose your connection to the Australian Hunters. For example, it may be sufficient to include a statement such as #Australian Hunters or a link to the Australian Hunters club sign up page.

g) Additional Terms. Sponsor, together with Australian Hunters, reserves the right to modify or cancel a giveaway at any time. Sponsor and Australian Hunters and its affiliates are not responsible for: (a) lost, misdirected, misleading or incomplete member information required for selection or postage of giveaway prize; (b) any operation or transmission error, theft, unauthorized access to, or alteration of, entries; or (c) damage to any computer or device resulting from downloading Australian Hunters materials. Sponsor, together with Australian Hunters, may disqualify any individual found to be: (x) tampering with a giveaways; (y) violating these Terms & Conditions; or (z) acting in an unsportsmanlike or disruptive manner or with intent to threaten or harass any person. Incomplete and robotic, automatic, programmed or similar entries will be disqualified. The authorized subscriber of the account used to enter a giveaway at the actual time of entry will be deemed to be the participant and must comply with these Terms & Conditions in the event of a dispute as to entries submitted by multiple users having the same e-mail account.

No greater than the number of prizes stated in a giveaway announcement post will be awarded. If any errors occur in the selection of a potential winner, or if more prizes are claimed than specified, Sponsor or Australian Hunters may award the prize(s) by random drawing from among all eligible claimants. All prizes made available for a giveaway may not be awarded in the event Sponsor or Australian Hunters does not receive a sufficient number of qualified and eligible entries for an applicable giveaway.

h) Miscellaneous. Each Giveaway is governed by the laws of the Victoria, Australia. By entering a giveaway, you agree that Sponsor, Australian Hunters, and each of their respective affiliates and agents, and any entity involved in any aspect of the giveaway (all aforementioned parties are collectively, the “Released Parties”) will have no liability, and will be held harmless from and against liability, loss, injury or damage to property or person, including death, and reasonable attorney’s fees and court costs, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of a prize or participation in the giveaway, even if caused or contributed to by the negligence of any of the Released Parties.

You agree that Sponsor’s decisions related to each giveaway and all distribution of prizes are final. Each winner agrees that, by participating in a giveaway, Sponsor, Australian Hunters, and their respective affiliates may use the winner’s name in any manner and in any medium for its promotional purposes without additional compensation, including posting in a winner’s list, except where prohibited by law, and Sponsor, Australian Hunters, and their respective affiliates may be required to disclose the winner’s address to state regulatory authorities.

ii. Insurance & Genuine Reason

a) Insurance available to members of Premium membership (monthly and annual) and Platinum membership (monthly and annual) is provided by the Hunters and Shooters Association of Australia, AHO 13512, Hunter LEAP Provider Number: 13512, Victoria Shooting Club Permit number: 987-804-10S (Hence referred to as “HSSA”.

b) Genuine reason is also provided by the HSSA in conjunction with insurance. Genuine reason is a requirement for obtaining a firearm license in most states of Australia and should not be confused with game licences.

c) Premium and Platinum membership with the Hunting Trips Australia meets the Approved Hunting Organisation (AHO) requirements for you to apply for a Restricted Game Licence in NSW. You must have a valid AHO membership to maintain your NSW Restricted Game Licence. However, it is your NSW Restricted Game Licence which is your genuine reason in conjunction with your Australian Hunters membership.

d) The ACT Registry advises that it recognises the NSW R licence as satisfying recreational hunting as genuine reason in that territory.

e) Associated membership with the HSSA through Australian Hunters Premium membership (monthly and annual) and Platinum membership (monthly and annual) provides a ‘Genuine Reason to Own A Firearm’  in the following states, under the following firearm categories.

  • QLD – Category A, B, M firearms
  • VIC – Category A, B firearms
  • NSW – A, B  firearms (conditional on having a valid R-license)

Genuine reason is currently not offered for eligible members who live in Tasmania, Queensland, Northern Territory, South Australia or Western Australia. We are hoping this changes in the near future.

f) When seeking to use Australian Hunters and HSSA membership as the genuine reason for a new or renewal of a firearm license application members must first complete the ‘insurance and genuine reason‘ application form, accessed through the membership dashboard. Once completed this information will automatically be sent to the HSSA for processing. After processing your application the HSSA will send you an email confirming that your insurance and genuine reason are now active. Prior to receiving this email confirmation your certificate of membership is not valid evidence of genuine reason.

g) When you join the HSSA through either a monthly or annual Premium or Platinum Australian Hunters membership you are agreeing to the following:

  • you understand what the genuine reason is for, and the restrictions of where it applies in the context of your membership.
  • you agree to  HSSA’s ‘Deed of Assumption
  • that Australian Hunters will share your membership information with the HSSA to enable it to provide you with genuine reason and insurance;
  • to the rules of the HSSA, which you can view and download here.
  • to the privacy requirement of the HSSA to disclose your information to relevant licensing bodies, in particular, that your details must be given to Victoria Police;
  • to their policy of not providing refunds or exchanges due to a change of mind or members circumstances;
  • to uphold the good image of both  the HSSA, Australian Hunters and the shooting sports; and
  • that these requirements are subject to change, and are as posted on this website from time to time.

h) Annual subscriptions – Public liability insurance, and genuine reason provided as part of your membership through the HSSA is not automatically activated upon signing up for either the annual premium membership subscription or the annual platinum membership subscription. Once your membership order is processed and payment confirmed, you will need to visit the ‘insurance and genuine reason‘ page via the membership dashboard and complete the ‘apply for Insurance & ‘Genuine Reason” form.  Once completed this information will automatically be sent to the HSSA for processing. After processing your application the HSSA will send you an email confirming that your insurance and genuine reason are now active. Prior to receiving this email confirmation you are not covered under the HSSA’s insurance policy, nor can you use your certificate of membership as evidence of your genuine reason in order to obtain or renew a firearm license. Australian Hunters will then manage the yearly insurance and genuine reason renewal process.

i) Monthly subscriptions  – Public liability insurance, and genuine reason provided as part of your monthly membership through the HSSA is not automatically activated upon signing up for either the monthly premium membership subscription or monthly platinum membership subscription.  One the sign up date members who have purchased a monthly premium membership subscription or monthly platinum membership subscription must wait 92 days before they have the ability to manually apply for public liability insurance, and  genuine reason through the HSSA. After 92 days has elapsed users will be sent an email from Australian Hunters to their account email address with instructions on how they can complete their application. Alternatively, users can access the ‘insurance and genuine reason‘ page and application form via their members dashboard which becomes available to them after this period has elapsed. Once an application is completed and submitted via the member through the form on the insurance and genuine reason‘ page, this information will automatically be sent to the HSSA for processing. After processing your application the HSSA will send you an email confirming that your insurance and genuine reason are now active. Prior to receiving this email confirmation you are not covered under the HSSA’s insurance policy, nor can you use your certificate of membership as evidence of your genuine reason in order to obtain or renew a firearm license. Australian Hunters will then manage the yearly insurance and genuine reason renewal process.

j) Insurance and genuine reason provided through the HSSA as part of a Australian Hunters membership is ongoing from the date of the HSSA confirmation email, unless terminated by either the HSSA or Australian Hunters.

k) When seeking to make a claim under the public liability insurance please contact HSSA directly via their website  and provide your Australian Hunters member visable on your members certificate and claim information to them.

l) Australian Hunters and HSSA are separate legal entities that operate independently of each other.

m) In the event that your membership is cancelled  the insurance and genuine reason provided as part of this membership are also cancelled immediately. In this situation:

  • You are no longer covered under the HSSA insurance policy provided as part of your previous membership and cannot make any future claims.
  • Your genuine reason for owning a firearm via your Australian Hunters membership, provided by HSSA is no longer valid.  As required by law you must provide an alternative genuine reason to your state firearm regulatory body immediately or risk loosing your licensee and firearms.
  • Australian Hunters and the HSSA are legally required to report any cancellations of memberships containing genuine reason and insurance to relevant state firearm regulatory bodies.

iii. Subscription & payment terms

a) Payment

Scheduled subscription payments by your nominated credit card is processed via Stripe. To learn more about Stripe and it’s security protocols and the protection of your data please visit the Stripe website.

Payment All prices and dollar amounts on this Website are in Australian dollars.

We reserve the right to stop accepting credit cards from one or more issuers.

By submitting a credit card number to Stripe via Australian Hunters you are representing and warranting that the credit card information you provide is valid, authentic, current, and one that you are authorized to use it.

You agree that in the event the credit card information you have provided becomes invalid, out of date or that you are no longer authorized to use the card, you will immediately provide another credit card number that is valid, authentic and current, and which you are authorized to use. Credit card information can be changed via the accounts page.

Some electronic transactions may require extended processing in addition to credit card authorization. This may affect to your access to member content or restricted members areas.

b) Failed payments.

If a charge against a credit card you provide is not authorized or accepted, or is subsequently refused or rejected, we reserve the right to cancel your order without notice or liability.

When a scheduled credit card payment fails Australian Hunters commences a payment retry process which can take up to 8 days to complete fully. During this process the users membership is temporally suspending, along with their access to membership content.

The retry system works by applying a set of retry rules whenever a renewal payment fails. The full set of retry rules defines the specific behaviour of the retry process between the first failure and finally declaring the payment as failed and no longer attempting to process the payment. The general retry process proceeds like this:

  1. Automatic recurring payment fails.
  2. The website checks if a retry rule exists for this specific payment failure.
  3. If a rule exists, it is applied and Subscriptions will:
    • schedule a pending retry event to occur after a set period of time
    • set the status on the subscription to match the status defined by the rule
    • set the status on the order to match the status defined by the rule
    • email the customer the email defined by the rule
    • email store managers the email defined by the rule
  4. When the scheduled time for the retry event arrives, the website will retry the payment if:
    • the retry still has a status of pending
    • the order still requires payment
    • status on the subscription matches the status defined by the rule previously applied
    • status on the order matches the status defined by the rule previously applied
  5. If the payment fails on this retry attempt, steps 2 through 4 are repeated until there are no more retry rules.

If no rule exists, either because the all retry rules have been exhausted or the retry system cannot be applied to the renewal order, the renewal order is marked failed and the customer is sent the Customer Renewal Notification email.

To regain access to the membership the customer will need to log in to the website and reactive their membership subscription via the subscription page in the accounts section, by adding in a valid credit card. Failure to do so will not change the membership status from being suspended.

c) Reoccurring billing.

Membership products consist of a recurring period charges as agreed to by you. By choosing to purchase a membership subscription plan, you acknowledge that such Services have a recurring payment feature and you accept responsibility for all recurring charges prior to cancellation. All recurring payments are fully earned upon payment. You can learn more about your subscription billing frequency via the subscriptions information accessed via your account page.

Unless up or down graded, your subscription will be automatically extended for successive periods, at the then-current subscription rata.

c) Switching memberships/subscriptions

Users with active membership can upgrade and downgrade subscription members whenever they want.

To change a subscription the user must go to their ‘Accounts page’ and click on the ‘Subscriptions‘ tab. This will take them to their membership subscription page where they can click the ‘Upgrade or Downgrade Membership’ button in ‘Subscription totals’ area.

Now the user can select a new membership subscription from the list including monthly and annually variants of the basic, premium and platinum memberships.

Note switches are prorata and additional payment may be required to complete the process.

Members switching from basic to either premium or platinum monthly memberships should be aware that access to application for insurance is not immediate or automatic.

One the date of successful switch members who have switched from a basic membership (annual or monthly) to either a monthly premium membership subscription or monthly platinum membership subscription must wait 32 days before they have the ability to manually apply for public liability insurance, and  genuine reason through the HSSA. After 32 days has elapsed users will be sent an email from Australian Hunters to their account email address with instructions on how they can complete their application. Alternatively, users can access the ‘insurance and genuine reason‘ page and application form via their members dashboard which becomes available to them after this period has elapsed. Once an application is completed and submitted via the member through the form on the insurance and genuine reason‘ page, this information will automatically be sent to the HSSA. After processing your application the HSSA will send you an email confirming that your insurance and genuine reason are now active. Prior to receiving this email confirmation you are not covered under the HSSA’s insurance policy, nor can you use your certificate of membership as evidence of your genuine reason in order to obtain or renew a firearm license. Australian Hunters will then manage the yearly insurance and genuine reason renewal process.

iv. Account Suspension and Termination

Upon purchase of a membership subscription you are given access to an account that is created for you. This account is  to assist in use of the website and it’s membership features. By continuing to use this Website you represent and warrant that: (i) all information you submit is accurate and truthful; (ii) you have permission (if required) to submit payment information; and (iii) you will keep this information accurate and up-to-date.

Australian Hunters may suspend or terminate your account and or your right to utilize the services made available through this Website in the event that it determines or has reasonable grounds to suspect that you are in violation of the Site Terms.

Notwithstanding any of these Site Terms that may suggest otherwise, Australian Hunters reserves the right without notice and in its sole discretion, to terminate, block or prevent future access to and use of this Website by you for any reason or no reason at all, including but not limited to failed scheduled payments (see b) failed payments), abusive, sexist, racist, disrespectful or violent behaviour, public slander of Australian Hunters or it’s membership program, Public sharing of member only  discount codes, unlawful actions, use of Australian Hunters intellectual property without consent, with or without cause and without notice or liability to you or any third party. In the event your right to use this website is terminated, these Site Terms shall still apply.

v. Cancelation of membership

We may cancel a membership order (including any membership orders that we have accepted) without any liability to you for that cancellation at any time if

1. There is an error in the price or the product description posted on the Site in relation to the relevant product in that order; or

2. That order has been placed in breach of these terms and conditions.

If we do so, then we will endeavour to provide you with reasonable notice of that cancellation, and will not charge you for the cancelled order if we cancel it before the delivery date or if you are not at fault or in breach of these terms and conditions.

To cancel a membership a user must provide a written statement of their intention via the form on the contact page 7 days before their next scheduled monthly membership payment, or 14 days prior to their next annual membership payment. Failure to do so may result in additional charges. Upon receiving your request Australian Hunters will review your account and in the event there are no outstanding payments due your membership will be cancelled and you will be notified via email.

If you cancel your subscription, you will not be eligible for a prorated refund of any portion of the subscription fee pad for the then-current subscription period. Cancellation of subscriptions also voids any users active giveaway entries.

Non members must not use, or share product discount information they previously had access to. Use of discounts outside of membership may result in prosecution and legal action. Discount codes are regularly chanced, however old codes are still monitored and information collected on nefarious use.

In the event that your membership is cancelled  the insurance and genuine reason provided as part of this membership are also cancelled immediately. In this situation:

  • You are no longer covered under the insurance policy provided as part of your previous membership and cannot make any future claims.
  • Your Australian Hunters/HSSA genuine reason for owning a firearm is no longer valid.  As required by law you must provide an alternative genuine reason to your state firearm regulatory body immediately or risk loosing your licensee and firearms.
  • Australian Hunters and HSSA are obliged to report any cancellations of memberships containing a genuine reason to relevant state firearm regulatory bodies.

vi. Modifications To The Service And Prices

Prices for our products are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

vii. Products Or Services

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

vii. Course and product discounts

Course and product discounts are provided to members as part of their membership and subscription. Australian Hunters reserves the right to suspend or terminate without notice membership of any user in the event that it determines or has reasonable grounds to suspect that a member has shared with a non member course of product discount codes, links, promotions or information about discounts.

viii. Member discounts on selected listed hunts.

Member discounts on hunts advertised on Hunting Trips Australia are displayed as a ‘member price’ on the listing and listing preview. The decision to list a member discount on a given hunt is the responsibility and decision of the individual outfitter and is subject to change. Hunting Trips Australia and Australian Hunters make no guarantee on the number of listed hunt discounts available to members, or the value of such discounts. For more information about the number price of a specific hunt or course listed on the website please contact the outfitter via the form on that listing.

Intellectual property rights

Unless stated otherwise, we own the huntingtrips.com.au and australianhunters.com.au websites including all of the text, images, software, trademarks or other materials contained on our website. You will not copy or transmit any part and/or content of our website, except for your personal, non-commercial use on your computer.

If you provide us with feedback including but not limited to Hunter’s reviews, suggestions, ideas, ratings or any similar or related, you agree that: (a) we own the feedback and any intellectual property rights associated with it; (b) we can use and share your feedback without your consent; and (c) at our request and expense, you will execute documents and take such further acts as we may reasonably request to assist Hunting Trips Australia and Australian Hunters to acquire, perfect, and maintain its intellectual property rights and other legal protections for the feedback. We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. Host A Hunt

Australian Hunters club members have the ability to ‘host a hunt’, that is, to create a personal hunting listing to be advertised on both the Hunting Trips Australia website (huntingtrips.com.au) and Australian Hunters website (australianhunters.com.au) and social media, available for participation by other club members.

All Host A Hunt activities are organised, facilitated and run by the user who created them, they are not official Australian Hunters or Hunting Trips Australia activities, rather they are personal to that user, facilitated outside of Hunting Trips Australia and Australian Hunters and not associated with Hunting Trips Australia or Australian Hunters.

Neither Hunting Trips Australia nor Australian Hunters are liable for any damagers that may occur during, or as the result of this activity.

By creating a Host A Hunt listing you acknowledge the following;

  • That you are creating, facilitating and managing this activity yourself, this is not activity managed by Hunting Trips Australia or Australian Hunters, nor is it an official club activity.
  • That you will not operating in the capacity of a professional hunting guide, nor will you be providing any professional hunting services
  • That you acknowledge that hunting has certain risks, hazards and dangers that include, but are not limited to:
    • The risk of handling dangerous weapons and other equipment used for hunting and the risk of being near others that have dangerous weapons and other equipment used for hunting in their possession
    • The risk of injury from the discharge of weapons either by other hunters or yourself, whether accidental, intentional, or caused by malfunction of the same.
    • The risk of injury from walking in rugged terrain and the natural erosion to both property and roadways.
    • The risk of injury from encounters with poisonous plants, venomous snakes, insects, spiders and animals (both wild and domestic).
    • The risk of encountering inclement weather conditions.
  • That you understand the risks, hazards and dangers associated with hunting and will take the opportunity to discuss these risks with any participants you agree to take with you on your hunt.
  • You agree that these terms are sufficient warning of the risks, hazards and dangers of hunting and that your participation in this activity is personal, and not associated with Australian Hunters, Hunting Trips Australia or it’s partners.
  • You acknowledge that you are responsible for your own safety, and the safety of those around you.
  • You agree that when facilitating your personal hunt you will:
    • conduct yourself in a proper manner.
    • comply with all federal and state hunting laws and regulations, whenever engaged in activities over which such state may have jurisdiction.
    • not take, or be under the influence of any illegal or substances.
    • not have a blood alcohol level over 0.00 during the hunt.
  • You acknowledge that you have valid firearm and game licenses for the state you are hunting.
  • As the host of the hunt you agrees to release, hold harmless and unconditionally indemnify and defend both Australian Hunters and Hunting Trips Australia, against any and all liability, costs, expenses, claims and damages which Hunting Trips Australia or Australian Hunters may at any time suffer or sustain or become liable for by reason of any accidents, damages or other injuries, either to the person or property, or both of hunter or of any other parties in any matter arising from the agreement or from the hunting operations performed here under, including but not limited to, any negligent act or omission of Hunting Trips Australia or Australian Hunters upon which the hunting activities occur. Hunting Trips Australia and Australian Hunters shall be indemnified for all costs required to enforce this agreement including court costs and legal fees.

Limitation of Liability

Except as provided in this warranty and to the extent permitted by law, Hunting Trips Australia and Australian Hunters shall not be responsible nor liable for any loss, damage, or injury (including death) to any party, individual, or entity nor be responsible for other casualty of any kind, including but not limited to direct, indirect, special, incidental or consequential damages resulting from any breach of warranty or condition or any other reason, or under any other legal theory, including but not limited to loss of use; loss of revenue; loss of actual or anticipated profits (including loss of profits on contracts); loss of the use of money; loss of anticipated savings; loss of business; loss of opportunity; loss of goodwill; loss of reputation; loss of, damage to or corruption of data; or any indirect or consequential loss or damage howsoever caused, including the replacement of equipment and property, any costs of recovering, programming, or reproducing any program or data stored or used with Hunting Trips Australia products and any failure to maintain the confidentiality of data stored on the product. Some states or countries do not allow the exclusion or limitation of incidental or consequential damages, in which instance, this paragraph will be given the greatest effect allowable by law.
